
According to a report by the Altoona Mirror, US regulatory authorities attempted to block the Chinese e-cigarette brand ELFBAR four months ago. However, it has been proven that this disposable e-cigarette is still in high demand, and the reason behind its popularity is quite simple: it underwent a name change.
Convenience stores in cities such as Washington D.C., Philadelphia, and New York are still filled with diverse e-cigarettes. These tobacco products come in various flavors, such as strawberry and cantaloupe, and claim to provide 5000 puffs per device.
The new e-cigarette model has been renamed as EBCreate, which differs from the manufacturer names listed on the FDA target list. These products primarily enter the United States through major freight centers such as Los Angeles and Houston.
Brian King, the Director of Tobacco at the FDA, has stated that the agency is closely monitoring companies attempting to avoid detection by altering their branding strategies.
In his statement, Jin said:
The public and e-cigarette importers should be aware that the FDA has a range of tools at its disposal to combat these strategies. He noted that the FDA has the ability and will indeed add new brands and product types to its import alert.
According to public records, ELFBAR swiftly underwent a brand transformation after the FDA imposed an import ban in May this year.
Two weeks later, the trademark application using EBCreate was submitted to the United States Patent and Trademark Office. The application was once again submitted by the same patent attorney who had previously filed for ELFBAR. However, unlike the previous application, the submitted documents did not mention the parent company of Elf Bar, IMiracle (Heaven Gifts) (Shenzhen) Technology Co., Ltd.
