Seoul Metropolitan Council Addresses Regulatory Gaps in Vape Industry as Youth Usage Surges
Kim Kyung-hoon, a member of the Seoul Metropolitan Council's Education Committee, raised the issue of vape regulation at an administrative audit meeting, pointing out that the product contains nicotine and is popular among teenagers, calling for stricter measures.

Kim Kyung-hoon, a member of the Seoul Metropolitan Council's Education Committee, raised the issue of vape regulation at an administrative audit meeting, according to a report by n.news on November 13. 

 

Kim pointed out that the product, unlike regular cigarettes, has a fruit flavor and is difficult to distinguish from regular smoking, but it contains nicotine. A survey by the Korea Disease Control and Prevention Agency shows that about 70% of teenage smokers start using vapes, highlighting the severity of the problem.

 

Kim emphasized that vapes are likely to be used as drugs and there are distribution channels among teenagers. He called on the Education Office to strengthen enforcement, investigate the situation, and take appropriate measures. The Seoul Metropolitan Office of Education responded that there is no separate data on the current situation, and vapes are not included under the current tobacco laws, which would require legal amendments.

JT Plans ¥800 Billion Investment in Heated Tobacco Over Three Years, Betting on Ploom as Second Growth Engine
Japan Tobacco Inc. (JT) CEO Takehiko Tsutsui said the company plans to invest about ¥800 billion (approximately US$5.4 billion) in heated tobacco products over three years through 2028, aiming to establish Ploom as a second growth engine after combustible cigarettes. Tsutsui said Ploom AURA helped JT increase its share of Japan’s heated tobacco market to 15.8% in the first quarter of 2026. Ploom products are now available in 29 markets, with Ploom AURA sold in 25 markets including Japan. JT also plans to continue its cigarette business while positioning its food operations, particularly frozen noodle products in North America, as another growth opportunity.

The U.S. Court of Appeals for the Ninth Circuit upheld the FDA’s denial of MH Global LLC’s applications to market flavored electronic nicotine delivery systems (ENDS). According to VitalLaw on August 27, 2026, the U.S. Court of Appeals for the Fifth Circuit vacated an FDA marketing denial order (MDO) against NicQuid LLC, ruling that the agency’s comparative-efficacy standard for electronic nicotine delivery system (ENDS) applications had become a substantive rule requiring notice-and-comment rulemaking under the Administrative Procedure Act (APA). The court did not reject FDA’s authority to compare the public health benefits and risks of flavored vapes, but held that the agency could not establish a broadly binding standard through informal adjudications. The case was remanded to FDA for further proceedings.
