U.S. Court Temporarily Halts Ban on Sales of Vuse Alto Mint-flavored Vapes
Reynolds E-Cigarette Company (RJRV) successfully obtained an emergency administrative injunction from the U.S. Court of Appeals for the Fifth Circuit, temporarily putting on hold the U.S. Food and Drug Administration's (FDA) ban on the sale of Vuse Alto mint-flavored e-cigarettes (MODs).
This decision means that these e-cigarette products will continue to be available on shelves across the United States.
Reynolds Marketing Services Co. (RMSC), a subsidiary of British American Tobacco (BAT), wrote in a letter to retail and wholesale customers:
"We are confident in the quality of RJRV's applications, which are based on years of scientific research and investigation, and we believe they contain sufficient evidence that FDA was able to determine that the sale of these products is appropriate to protect public health."
The letter added: "RJRV's Vuse Alto application shares basic science with the applications for Vuse Vibe, Vuse Solo and Vuse Ciro, which have been granted October 2021 and May 2022 sales licenses for original flavors, representing the broadest portfolio of sales licenses offered by any company in the United States." During the suspension, Vuse Alto mint-flavored e-cigarettes can still be sold."
