On March 19, according to the New York Post, U.S. Senator Chuck Schumer called on the FDA to investigate a popular Chinese-made e-cigarette and "prepare to ban it from the market." He believes the e-cigarettes circumvent U.S. advertising laws by directly appealing to children and teens through social media.

 

According to the official website of the U.S. Congress, Schumer is now a member of the Democratic Party and a senior federal senator from New York State. He is currently the Senate majority leader.

 

Accuses ELFBAR of Marketing via Social Platforms

 

Schumer stated on March 19 that ELFBAR appealed to children with child-friendly flavors such as Skittles, Peach Mango, Cotton Candy, and Vanilla Ice Cream. The colorful packaging also attracts young customers.

 

He also stated that while the FDA has done much to kill brands like JUUL, e-cigarettes like ELFBAR are still being marketed using workarounds and illegal methods. He accused ELFBAR of marketing products through commercial cooperation with internet influencers on social platforms, such as TikTok and Instagram.

 

"We must get ahead of this tactic that could circumvent the FDA's advertising rules," Schumer said in a statement.

 

Calls to 'Ban It from the Market.'

 

In June 2022, the FDA issued a marketing ban on JUUL, which forced JUUL to remove its products in the United States. Schumer said ElFBAR could be worse than JUUL, given its "poor manufacturing process, the risk of counterfeit products and their risk of mislabeling nicotine levels."

 

He added that federal regulators must use their "full authority and powers to investigate and take action against ELFBAR and prepare to ban it from the market."

 

Schumer's Previous Position

 

Schumer co-sponsored with two other senators, The Cannabis Administration and Opportunity Act (CAOA), which would remove marijuana from the Controlled Substances Act, making the possession and use of marijuana no longer a crime. It would also eliminate low-level federal marijuana convictions.

 

Schumer also expressed his concern about "Vaping" in August 2016. He claimed in the news that "too many electronic cigarette devices are time bombs."
