VPR Brands settles patent infringement with XL Vape.

On March 18, 2022, our company reached a settlement agreement, known as the "XL Settlement Agreement," with XL Vape, LLC ("XL"), VGOD LLC ("VGOD"), Saltnic LLC ("Saltnic"), and the "XL Parties," which includes XL and VGOD. Previously, our company had filed a civil lawsuit for patent infringement against XL (the "XL Action") in the United States District Court for the Central District of California (Civil Action No: 2:21-cv-01110(MCS)). Pursuant to the terms of the XL Settlement Agreement, our company and the XL Parties have agreed to settle the XL Action. Furthermore, the XL Parties have agreed to pay our company $155,000. Our company has also granted non-exclusive, fully-paid, and royalty-free licenses to the XL Parties to practice the inventions described in the patents, as well as all related patents and applications, both domestic and foreign.

 

The company holds proprietary intellectual property and is one of the original patents filed for electronic cigarette technology. The patent dates back to 2009 and includes independent claims regarding electronic cigarette products with electric airflow sensors, including sensors composed of diaphragm microphones. These sensors control the battery switch and cover most automatic, buttonless e-cigarettes, cigarette-like electronic smoking devices, and vaporizers that use airflow sensors instead of buttons. This technology falls under practical patent US 8,205,622 for electronic cigarettes.

 

VPR Brands and SRIPLAW have begun identifying and notifying over 50 leading companies using Auto Draw technology, as VPR Brands intends to vigorously enforce its patent. These companies have been prioritized based on sales and popularity. Recently, VPR Brands LP and its legal team led by Joel B Rothman of SRIPLAW have filed lawsuits against 9 of these companies. Additional lawsuits may be filed if necessary to protect the company's intellectual property.

 

The electronic cigarette industry has reached maturity and is continuing to grow. The company believes its patents position it uniquely to take advantage of the recent surge in electronic cigarette/e-cigarette use. Some analysts predict that the electronic cigarette market will reach $6 billion (excluding devices used for marijuana and CBD).

 

Currently, the majority of nicotine electronic cigarette devices sold in the United States use automatic draw/no button technology. The company is investigating all buttonless electronic cigarette devices in the nicotine, CBD, and cannabis space for potential violations, as these devices vaporize from the user's inhalation of the air flow.

 

The company may also seek buyers for this patent in the future. As an example of past e-cigarette patent sales, another company, Ruyan, obtained a U.S. patent for its e-cigarette product. In August 2013, Imperial Tobacco Group acquired the intellectual property behind Ruyan's e-cigarette for $75 million. The market was not at the same level as it is today at that time, but there has been significant growth since 2013.

 

Previously announced agreement:

 

Starting from December 1st, 2021, VPR Brands, LP ("the Company") and NEPA 2 Wholesale, LLC ("NEPA") have entered into a specific settlement agreement ("the Settlement Agreement"). Pursuant to the terms of the settlement agreement, the Company and NEPA have agreed to settle the lawsuit filed by the Company against NEPA alleging patent infringement involving United States Patent No. 8,205,622 ("the Patent"), with NEPA agreeing to pay the Company $275,000. Additionally, pursuant to the terms of the settlement agreement, the Company has agreed to license the Patent and related patents and applications to NEPA and certain affiliated companies.

 

On December 30th, 2021, VPR Brands, LP ("the Company") entered into a settlement agreement ("Settlement Agreement") with PHD Marketing, Inc. ("PHD"). Prior to this agreement, the Company had filed a lawsuit (Civil Action No. 21-cv-03797) against PHD in the United States District Court for the Central District of California, alleging patent infringement of U.S. Patent No. 8205622 ("the Patent") ("the Lawsuit"). Pursuant to the terms of the Settlement Agreement, the Company and PHD agreed to settle the action. Additionally, PHD agreed to pay the Company $85,000. The Company also granted PHD a non-exclusive, non-assignable license to practice the invention as defined by the Patent.

 

On March 18, 2022, our company entered into a settlement agreement ("XL Settlement Agreement") with XL Vape, LLC ("XL"), VGOD LLC ("VGOD"), Saltnic LLC ("Saltnic"), and XL and VGOD together (the "XL Parties"). This follows the company's previous lawsuit for patent infringement ("XL Action") against XL in the United States District Court for the Central District of California (Civil Action No: 2:21-cv-01110(MCS)). Under the terms of the XL Settlement Agreement, the company and the XL Parties have agreed to settle the XL Action. In addition, the XL Parties have agreed to pay the company $155,000. The company has also granted the XL Parties a fully paid-up, royalty-free, non-exclusive license to practice the inventions described in the patent as well as all related domestic and foreign patents and applications.
