Controversy Surrounding E-Cigarette Sales Regulation in South Dakota
South Dakota House passes bill requiring licenses for e-cigarette sales, sparking controversy among local smoke shops.

According to KOTATV on February 11th, the South Dakota House of Representatives passed House Bill 1069 with 57 votes in favor and 11 votes against. The bill aims to regulate the sale of e-cigarettes in the state. It requires businesses selling e-cigarettes to obtain a distribution license for e-cigarette products, with each sales location needing to apply separately. Additionally, distributors need to be certified by e-cigarette manufacturers in order to sell the products. This bill has sparked controversy among local tobacco shops.


Broderick Harrington, manager of "Smoke Solutions" smoke shop in Rapid City, South Dakota, believes that if the bill aims to ensure the qualifications and compliance of distributors, then it is reasonable; however, if it is to increase the difficulty of transactions between retailers and distributors, it is a waste of time. He believes that ensuring the qualifications of distributors is necessary to prevent them from engaging in illegal activities.


Currently, the bill has been submitted to the South Dakota State Senate for consideration.
