Denton ISD Exempts E-Cigarette Behavior from State Requirements
Denton Independent School District in Texas exempts e-cigarette behavior from new state law requirements, allowing for local control.

According to a recent report by Crosstimbersgazette, the board of trustees of the Denton Independent School District (Denton ISD) in Texas has recently granted exemptions for the district to comply with new state laws regarding e-cigarette usage.

 

According to a report, the board of directors approved a revision to the current innovation zone plan on June 26, exempting the Denton Independent School District from the provisions outlined in §37.006 of the Texas Education Code. As per a press release issued by the district, this exemption does not apply to e-cigarette violations related to drug prohibition.

 

This change is a response to House Bill 114 (HB 114) in the Texas House of Representatives, which went into effect on September 1st after being passed in the 88th Texas Legislature. The new Texas Education Law specifically targets students who are placed in disciplinary alternative education programs for possessing, using, selling, giving away, or delivering e-cigarette devices, regardless of whether those devices contain controlled substances.

 

Denton Independent School District's chief legal counsel, Deron Robinson, stated:

 

We will continue to strengthen our management of student e-cigarette behavior, regardless of whether it contains regulated substances. We are aware that this is an issue that needs to be addressed for the young people in our community, and we are taking measures to address it on campus.

 

The passage of the exemption regulation implies that the use of e-cigarettes will be subject to penalties as specified in behavioral norms, without automatically entering the DAEP placement program. However, any violations related to controlled substances will still be subject to DAEP placement as required by law.

 

Furthermore, with the exemption provision in place, the Dutton Independent School District will be allowed to continue promoting local control in areas that benefit curriculum, instruction, governance, and any other essential aspects necessary to uphold the district's commitment to the success of every child.
