Indiana vape tax to go into effect July 1

The new tax rate will be an added 15% of the wholesale price on all e-cigarette cartridges and vaping products.

Indiana will join over half of U.S. states by implementing a vape tax on July 1.

The tax was originally set to add 25% to the wholesale price on all e-cigarette cartridges and 15% to all additional vaping products, but Senate Bill 382 lowered this rate before it was even put into effect to ensure that it was the same across the board. The new tax rate will be an added 15% of the wholesale price on all e-cigarette cartridges and vaping products. This tax is additional to sales tax, which is 7% in the state of Indiana.

Currently, there are 30 other states with a statewide vape tax.

The new law also adds several high-risk and socially sensitive sectors to the list of prohibited business activities, including narcotics, wildlife trade, human organs and embryos, sex work, human cloning, fireworks, debt collection, and trade of national treasures.

UPC Court of Appeal refuses to revive VMR’s European vape patent, upholding lack of inventiveness

The Unified Patent Court’s Court of Appeal declined on Dec. 29 to revive a European patent held by VMR Products LLC, upholding a finding that the patent is not inventive over earlier devices. The decision said adding a window in the vape’s outer shell to reveal the internal cartridge holding vape liquid was an obvious, routine adaptation based on an earlier U.S. patent and general knowledge.
