
According to a report by Kios on December 31st, the government of the state of Iowa in the United States has decided to delay the implementation of a new regulation that would restrict the sale of e-cigarettes in the state. This decision comes in response to a lawsuit claiming that the regulation is unconstitutional.
A group of retailers, distributors, and e-cigarette manufacturers in Iowa were previously suing to block the enforcement of a new law, claiming that it would severely restrict the sale of e-cigarettes and benefit big tobacco companies. Last spring, the Iowa legislature passed and Governor Kim Reynolds signed into law House File 2677, which established a registry for e-cigarette products to be reviewed by the U.S. Food and Drug Administration (FDA).
According to the law, retailers can only sell products listed on the state-approved registry, with the exception of a few FDA-authorized products and pre-market tobacco application (PMTA) products still under review by the agency. The Iowa Department of Revenue recently announced that the release and enforcement of the e-cigarette product catalog has been postponed until further notice.
According to court documents, officials had originally planned to release a catalog of e-cigarette products on Thursday and begin enforcement on February 3. However, representatives from the state government filed a request on December 26 asking for more time to respond to the lawsuit and plaintiffs' preliminary injunction request. The Iowa Department of Revenue agreed to postpone the implementation of the new law until the court rules on the injunction request and any subsequent appeals.
