2Firsts, October 31, 2025 — Luxembourg has passed Bill No. 8333 on tobacco control, marking a significant reform of its public health policy. The legislation transposes EU Directive (EU) 2022/2100 and expands national restrictions to heated tobacco, e-cigarettes, and nicotine pouches.
Under the law, flavourings for heated tobacco are banned, and packaging must carry health warnings. Cigarette packs may only be sold in multiples of five, and vending machines must display health warnings and remove promotional graphics.
For the first time, nicotine pouches fall under tobacco regulations:
- Advertising and sales to minors are banned;
- Packaging and labelling requirements apply;
- Nicotine content capped at 0.048 mg per pouch/gram;
- Additives such as CBD and caffeine are prohibited;
- Use is restricted in public spaces frequented by youth.
Health organisations including the Cancer Foundation, Medical College, and Children’s Ombudsman (OKAJU) welcomed the move as necessary, though the Medical College urged clearer separation between consumer and cessation products.
The Chamber of Commerce, however, criticised the law as “gold-plating” EU rules, arguing that strict limits on nicotine amount to a de facto ban and could spur black markets and cross-border sales. Businesses also faulted the government for providing no adequate transition period.
The Council of State lifted its last reservations in July 2025, allowing the bill’s adoption without a second constitutional vote. The law takes effect on the first day of the month after publication in the Journal Officiel, with vending display rules applying after a three-month grace period.
