2Firsts, January 16, 2026 – According to Infobae, Mexico will impose an absolute ban on the commercialization, import and sale of vapes and e-cigarettes starting January 16, 2026. The measure derives from a reform published in the Official Journal of the Federation (Diario Oficial de la Federación, DOF) amending the General Health Law (Ley General de Salud).
The report states that the rule establishes an absolute prohibition on activities linked to e-cigarettes, vapes and similar devices, including manufacturing, preparation, distribution, packaging, transport, storage, commerce, sale and supply. The restriction applies to both single-use products and rechargeable models, and also covers accessories and substances used in these devices. It further prohibits any advertising, promotion or propaganda related to these products in all media.
The legal text permits personal possession and personal consumption of vapes and e-cigarettes as long as there is no commercial intent or intent to distribute.
For violations, penalties may reach one to eight years in prison and fines of up to 2,000 times the daily value of the Unit of Measurement and Update (UMA). Health authorities are empowered to carry out seizures and order closures of establishments that fail to comply.
