2Firsts, December 12, 2025 – According to El País and official Senate records, Mexico’s Senate has passed a reform to the General Health Law banning the production, importation, sale, and advertising of e-cigarettes and vape devices across the country.
The bill, approved with 76 votes in favor, 37 against, and one abstention, introduces penalties of up to eight years in prison for commercial sales. Personal consumption and possession, however, will not be penalized.
Proposed by President Claudia Sheinbaum, the reform aims to protect public health and address the rapid, unregulated growth of the vape market. Supporters argued that the ban is necessary to prevent nicotine addiction among youth, citing the presence of harmful substances such as nicotine, metals, and carcinogens.
Opposition lawmakers warned that the measure could strengthen organized crime. Gina Campuzano (PAN) called it “a cynical smokescreen,” while Carolina Viggiano (PRI) argued that “the state must regulate, not prohibit.”
The reform adds a definition of e-cigarettes and vapes as devices capable of heating or vaporizing liquid or gel substances and bans all forms of advertising in print, broadcast, and digital media. The law will take effect upon publication in the Diario Oficial de la Federación.
