
According to a report by Fox News on April 17, the American watchdog group "Public Trust Protection Organization" (PPT) has filed a lawsuit against the Biden administration over the ban on menthol cigarettes.
The organization has filed a federal lawsuit against the Department of Health and Human Services (HHS), alleging violations of the Freedom of Information Act (FOIA). Last year, the organization submitted four FOIA requests to the department and its subsidiary agency, the Food and Drug Administration (FDA), regarding the ban on menthol cigarettes, but received no response to those requests.
The organization's chairman, Michael Chamberlain, was formerly a communications official at the Department of Education during the Trump administration. He stated in a press release:
The Biden administration and the FDA may have thought that they would be seen as conquering heroes when they announced the ban on menthol cigarettes. However, they quickly discovered that politics seemed much more complicated than that. This regulation is highly controversial, and it is important for the American public to understand the factors driving government action. Mr. Biden claims to be leading the most transparent government in history, but these agencies are not providing records. This seems to suggest that they do not want the public to know certain things.
According to the PowerPoint presentation, in the more than 90 days since the four requests were made, HHS has not provided any response. Therefore, the organization believes that HHS has not fulfilled its legal obligation to provide the required records for Freedom of Information Act requests.
Currently, the PPT has sought judicial review.
