Senate Urges FDA Enforcement on Unauthorized E-Cigarette Sales Review
Senate Judiciary Committee Chairman Dick Durbin urges FDA to enforce court order on unauthorized e-cigarette sales, seeks officials to testify.

According to a report from Courthouse News on May 7th, Dick Durbin, Chairman of the Senate Judiciary Committee, has urged the Food and Drug Administration (FDA) to enforce court orders for the review of unauthorized e-cigarette products being sold in the United States.

 

Dobbs criticized the agency in a letter in January, accusing them of "handing out free passes to dozens of e-cigarette products that harm the health of our country's children." Now, the spokesperson is working to bring FDA officials before Congress.

 

On Tuesday, he requested in a letter that Brian King, the director of the Center for Tobacco Products at the agency, and Brian Boynton, the chief Deputy Assistant Attorney General for the Civil Division of the Department of Justice, testify before the Senate Judiciary Committee. He specifically stated that the federal law enforcement agencies' task is to assist the FDA in enforcing violations of the Tobacco Control Act, including the marketing practices of e-cigarette manufacturers. That same day, Durbin took to Twitter to criticize the FDA for its lax enforcement of the e-cigarette market.

 

Despite the court setting a final deadline, the FDA continues to neglect its responsibility to mandate the removal of e-cigarette products from store shelves, as these products have failed to prove they are "appropriate for protecting public health.

 

In April, Dobin met with the two officials at a private meeting to discuss enforcement issues regarding unauthorized e-cigarettes. If the officials agree to testify publicly, the Judiciary Committee will hold a hearing in June.

 

The spokesperson for the FDA has not responded immediately to whether they will cooperate with this accusation.

China-based Hunan China Tobacco Industry Co., Ltd. and Shenzhen Baisha Technology Co., Ltd. have filed a patent application covering an adult-user identification mechanism for heated tobacco devices. The patent proposes using flexible pressure sensors installed in the device grip area to collect pressure distribution patterns generated when users hold the device. The system evaluates factors including effective contact area, grip shape and contact duration, and combines roller movement detection to determine whether unlocking conditions are met. According to VitalLaw on August 27, 2026, the U.S. Court of Appeals for the Fifth Circuit vacated an FDA marketing denial order (MDO) against NicQuid LLC, ruling that the agency’s comparative-efficacy standard for electronic nicotine delivery system (ENDS) applications had become a substantive rule requiring notice-and-comment rulemaking under the Administrative Procedure Act (APA). The court did not reject FDA’s authority to compare the public health benefits and risks of flavored vapes, but held that the agency could not establish a broadly binding standard through informal adjudications. The case was remanded to FDA for further proceedings.

China’s vape-related exports reached $1.047 billion in July 2026, up 16.5% year on year and the highest monthly total of the year. Growth was heavily concentrated in the U.S., where exports jumped 53.5% to $404 million and accounted for 94.9% of the overall increase. Exports to all other markets rose just 1.2%. By category, nicotine-containing non-combustible products—primarily vapes—under HS24041200 rose 24.7% and generated 95.5% of the total increase. Vape-device exports under HS85434000 fell 0.4%, while other nicotine-substitute products under HS24041990 grew 88.9% but remained comparatively small.
