Florida AG announces largest illegal vape seizure in state history, 2,183 contraband devices seized
Florida’s attorney general announced a record-breaking statewide enforcement push against illegal vaping products, with four joint operations seizing 2,183 contraband vapes and additional nitrous oxide-related items. Regulators also reported removing thousands of noncompliant products from store shelves, while investigations remain ongoing.

According to the Florida Attorney General’s Office, Attorney General James Uthmeier announced the largest seizure of illegal and contraband vaping products on Florida’s Nicotine Dispensing Device Directory in state history, following coordinated actions by the statewide Vape Task Force. The operations involved the Attorney General’s Enforcement Unit, FDACS, DBPR, and local law enforcement, targeting vape shops accused of selling products that violate Florida law and pose risks to children and consumers.

 

Across four task force operations, authorities seized 2,183 contraband vapes, along with nitrous oxide canisters, chargers, and related paraphernalia. The seizures included 263 illegal vapes in Clermont, 636 in Ocoee, 855 in Okaloosa County, and 423 in Milton.

 

Officials also reported seizing 195 nitrous oxide canisters from Unique Vape and Cigar during a compliance check and an additional 7 in Milton, along with 50 nitrous oxide chargers (“crackers”) and balloons used for inhalation. The Attorney General’s Office said the store owner, Golam Farooque, was arrested by the Okaloosa County Sheriff’s Office on eight felony counts of illegal sale of nitrous oxide.

 

FDACS conducted regulatory inspections and removed thousands of illegal products from shelves, including 2,054 packages from six stores in Clermont and 6,181 packages from eight stores in Ocoee, with totals from Okaloosa County, Milton, and Gulf Breeze still being finalized. Authorities cited multiple violations, including container and labeling failures, lack of child-resistant packaging, unlawful advertising and marketing, and packaging or branding designed to appeal to children. The release also referenced certain controlled or prohibited substances in connection with enforcement actions.

The U.S. Food and Drug Administration authorized 11 ZYN ULTRA nicotine pouch products made by Swedish Match USA through the premarket tobacco product application pathway on August 21, 2026. Ten of the authorized products have a labeled nicotine content of 9 mg, while ZYN ULTRA Smooth was authorized at 11 mg. The reviews were conducted through FDA’s nicotine pouch PMTA pilot program. FDA has now authorized 43 nicotine pouch products, including 23 through the pilot.

Japan Tobacco International's Irish business has proposed a €0.25 tax increase on a pack of 20 cigarettes in its pre-Budget 2027 submission, below the €0.50-or-more increases typically imposed in recent Irish budgets. JTI says the proposal could generate around €45 million in additional Exchequer revenue while limiting further movement toward illicit and non-Irish-tax-paid tobacco. Revenue's existing estimate for a comparable €0.25 increase, including pro-rata rises on other tobacco products, is about €18 million for a full year.

Three R.J. Reynolds companies are seeking to intervene in a lawsuit filed by Altria subsidiaries Helix Innovations and NJOY challenging the FDA's 2021 PMTA final rule. The companies dispute how the agency uses Acceptance and Filing reviews and completeness determinations to establish when the Tobacco Control Act's 180-day decision period begins. Reynolds has also linked prolonged PMTA reviews to competition from unauthorized vaping products. The FDA, meanwhile, has been accelerating reviews and reducing its backlog.

FDA Revises Import Alert 98-07 Rules, Bringing May Enforcement Priorities Into Unauthorized ENDS Detentions
The U.S. Food and Drug Administration has revised the rules under Import Alert 98-07 to incorporate its May 2026 enforcement-priority policy for certain electronic nicotine delivery systems marketed without premarket authorization. The alert continues to allow detention without physical examination, or DWPE, for ENDS lacking required marketing authorization, while directing field divisions to apply the May risk-based framework. When necessary, detention or refusal decisions must also undergo review by the FDA's Center for Tobacco Products. Products including PACHA and Vuse Pro have already emerged as industry examples of the May policy, although enforcement discretion does not constitute FDA marketing authorization.
