2Firsts, Nov. 11, 2025 — According to local Florida media, House Bill 389 would significantly expand restrictions on smoking and vaping throughout the state, covering streets, sidewalks, highways, beaches, parks, and the indoor and outdoor common areas of schools, hospitals, offices, restaurants, apartment complexes, and other public facilities.

The proposed law would make it illegal to smoke or vape tobacco or marijuana in these locations, though unfiltered cigars would remain exempt. The bill also allows exceptions, such as designated smoking rooms at airports.

Currently, counties and cities like Collier County and Naples already have local ordinances restricting smoking in certain areas. HB 389 would override these local rules to create a consistent statewide policy.

Lawmakers sponsoring the bill said the goal is to protect communities from secondhand smoke and ensure clear, uniform rules statewide. If passed, the new legislation would take effect on July 1, 2026.
