
On October 23rd, according to Medcom, the Indonesian Ministry of Agriculture has refused to accept the regulations on tobacco products in the Draft Government Regulation (RPP), which is the implementing regulation of the Health Law (UU). Clove and tobacco growers have voiced their opposition, believing that the regulations in the draft may stifle their livelihoods.
I Ketut Budhyman Mudhara, the Secretary General of the Indonesian Clove Growers Association (APCI), stated that the regulations should focus on regulating the national healthcare system. However, the current rules are overly broad, resulting in an expanded scope of impact. Therefore, he emphasized that clove growers disagree with and strongly oppose the regulations on tobacco products in the implementing regulation of the Health Law.
Yakub Ginting, the Chairman of the Agricultural Department's Plantation and Seasonal Crops Working Group, has assessed that the tobacco product regulations in the Health RPP could have a negative impact on the agricultural sector, particularly tobacco and clove farmers.
Furthermore, the Ministry of Agriculture has suggested to the Ministry of Health, through its legal bureau, to review certain provisions regarding tobacco products in the Health RPP. Among these, Article 439, Paragraph 1 of the Health RPP regulates cigarette packaging, requiring a minimum of 20 cigarettes per pack. Article 457, Paragraph 7 pertains to the command of transferring cultivation from tobacco plants to other plants, which is seen as violating the 2019 Law No. 22 on Cultivation. This law grants farmers the right to freely decide the type of tobacco and other plants to be cultivated.
