Juul Labs Files Lawsuit Against NJOY and Altria Over Patent Infringement

·In future developments, Altria plans to restart its federal court lawsuit against Juul based on previously unsupported patents.

 


 

According to an announcement on Juul Labs' official website on August 8th, Juul Labs has filed a lawsuit against NJOY company and Altria Group (Altria) with the United States International Trade Commission (ITC) and the Federal District Court for the District of Arizona. The lawsuit accuses NJOY's DAILY e-cigarette product of infringing on a patent owned by Juul Labs.

 

The current lawsuit is the latest development in a series of disputes between the two companies since 2023. In that year, Altria Group completely divested its ownership in Juul Labs and did not obtain the necessary licenses to use Juul Labs' intellectual property. Subsequently, Altria Group acquired NJOY and its products developed in China, which infringed upon Juul Labs' patented technology.

 

The recent lawsuit was initiated following Juul Labs' victory earlier in 2025 at the International Trade Commission. At that time, the International Trade Commission ruled that the NJOY ACE e-cigarette product developed by Altria Group in China infringed on four patents claimed by Juul Labs, and banned the import of the product to the United States.

 

In the same month, the International Trade Commission also terminated another patent infringement lawsuit filed by Altria Group against Juul Labs, as it determined that the patents claimed by Altria Group were not infringed.

 

Recently, Altria Group informed Juul Labs that it plans to restart federal court litigation against Juul Labs based on the same batch of patents that did not receive support in the International Trade Commission lawsuit against Juul Labs.
