Maryland Passes Bill to Regulate E-cigarette Tax, Debate on Flavor Bans Continues
Maryland passes e-cigarette tax bill, signaling progress in regulating ENDS, while debate on banning flavored products continues due to fiscal pressures.

According to a report from the NM Tribune on November 21st, recent developments in the state of Maryland have resulted in the passing of a bill regarding the taxation of e-cigarettes. This legislation signifies a significant advancement in the regulation of Electronic Nicotine Delivery Systems (ENDS) in the state.

 

However, the debate on whether to ban flavored e-cigarette products continues, influenced by financial pressures.

The European Anti-Fraud Office said on April 17 that its “JCO VAPE” operation, carried out together with customs authorities from 30 countries, successfully targeted the illicit trade in e-cigarettes and heated tobacco products. The operation, conducted from November 14 to December 15, 2025, resulted in seizures of more than 94 million items and more than 2,500 kg/l of tobacco products, e-cigarettes, devices, and related goods.

Goldman Sachs Managing Director Bonnie Herzog said the U.S. nicotine market is attractive and growing, with total revenue projected to reach about $67 billion by 2035. She expects cigarettes to account for a smaller share of revenue (47%) as smoke-free revenue expands and becomes a key driver of industry profit growth. Herzog said smoke-free products represent about 48% of U.S. nicotine volumes today and could rise to roughly 75% by 2035.
