Unveiling the FDA Crisis: Urgent Reform Needed in Tobacco Regulation

According to Tobacco Reporter on April 9th, former FDA senior official David Oliveira revealed the issues within the agency under the Biden administration, including tobacco control, diversity, equity and inclusivity, and the failures in combating the entry of illegal Chinese e-cigarettes into the US market.

 

Olivera stated during an interview with Fox News that:

 

Many of us had long anticipated this. We knew that the FDA truly needed to undergo a thorough reform in tobacco regulation. Because tobacco regulation has essentially spiraled out of control, the center has made numerous mistakes in several core tasks and requires a major overhaul and the appointment of new leadership.

 

Many of us, whether from the public health sector, consumers, small business owners, industry professionals, or even Senator Dick Durbin, who last year at a hearing said to Brian King, 'In my view, you have not fulfilled your responsibility.' So, in fact, people are dissatisfied with the recent actions of the FDA in tobacco regulation.

 

I often attend trade shows and visit e-cigarette stores. In a sense, I am like a 'canary in the coal mine,' reporting back on what I see and hear and warning them: the situation I have witnessed in real life is completely out of control. We have many people who just do online monitoring work, but when you actually step into the real world, you will see a large number of e-cigarette stores filled with these illegal products. I have also warned them about the nicotine content in these devices. From the original Juul device, which had approximately 200 puffs, equivalent to the nicotine content of a pack of cigarettes, I later saw devices with 5000 puffs. I brought this trend back to the center and as a result, the following year I saw products with 10,000 puffs. Now you can even find products on the market with 40,000 to 50,000 puffs.

 

This is the way Chinese people do things. They don't seek product authorization, but instead launch the latest and most advanced technology directly. I have also seen a red-and-white "Santa Claus" device. They also introduce flavors like "gummy bears," "bubble gum lollipops," and "fruit rolls" that are absolutely appealing to teenagers, because they simply don't care.
