US Court Rejects Logic's Request to Block FDA's Mint-Flavored E-Cigarette Ban
US court rejects Logic Technology Development's request to block FDA's ban on Logic's mint-flavored e-cigarette products.

Recently, according to a report by Law360, a US court has rejected the request from e-cigarette brand Logic Technology Development to prevent the US Food and Drug Administration (FDA) from imposing a market ban on Logic's menthol-flavored e-cigarette products.

 

According to reports, Japan Tobacco International (JTI) reached a acquisition agreement with Logic in 2015, incorporating the Logic brand into its operations. Prior to this, Logic had filed a petition for review with the US Court of Appeals for the Third Circuit, alleging that the FDA had violated the Administrative Procedure Act by denying its pre-market tobacco product application for the sale of its menthol flavored e-cigarette product. The court dismissed the request after determining that the FDA's decision was based on scientific judgment.

 

Logic claims that the FDA's application of the same regulatory framework for mint-flavored e-cigarettes as for fruit-flavored and dessert-flavored e-cigarettes is arbitrary and inconsistent. This also marks the FDA's first ever Market Denial Order (MDO) targeting mint-flavored e-cigarette products.
