Louisiana Releases VAPE List, to Remove Unauthorized Products from March 18
Louisiana to resume enforcing e-cigarette sales laws in 2024, requiring FDA-approved products only. Law previously challenged but now upheld.

According to a report by the American news station KPLC, the Louisiana Office of Alcohol and Tobacco Control (ATC) has announced that laws regulating the marketing and sales of e-cigarette products will be reinstated on March 18, 2024.

 

The office will publicly release a V.A.P.E. list on its official website, listing all e-cigarette or alternative nicotine products approved by the U.S. Food and Drug Administration (FDA). Since the law has taken effect, all unapproved e-cigarette products within the state of Louisiana cannot be legally sold, and retailers are required to remove products that are not included on this list.

 

Previously, the implementation of the law was suspended due to a lawsuit filed by the Louisiana convenience store and e-cigarette association, claiming that the law violated the constitution. However, following a permanent injunction hearing on February 21, 2024, the ATC stated that the court deemed the injunction no longer applicable, and the e-cigarette law can now be enforced.

 

Initially, in June 2023, the ATC passed a bill to triple the e-cigarette tax in Louisiana and ban the sale of e-cigarette products not approved by the FDA. The additional tax revenue is expected to be allocated to departments such as the state police.

 

This tax increase stems from Bill 414, HB635, which was signed into law by former Governor John Bel Edwards.

UK Vape Duty Starts in October as Hayati, DOJO and Others Launch Lower-Capacity Products With Lower Per-Unit Tax
The UK's Vaping Products Duty will take effect on October 1, 2026, at a flat rate of £2.20 per 10ml of vaping liquid. Ahead of implementation, DOJO, PIXL and Hayati have introduced or been reported to be adding lower-capacity tiers alongside larger products. DOJO has added a 6ml BLAST7K Fresh below its 10ml BLAST10K Fresh, PIXL offers both a 12ml 8000 and a 6ml 5K, while retailer Ninja Vapes says Hayati is preparing a 7ml 4K alongside its existing 12ml 6K. The pattern points to a growing lower-capacity tier in the UK market, although the brands have not all explicitly linked the changes to the new duty.

At the 2026 NACS Show in Las Vegas, Philip Morris International (PMI) showcased its ZYN nicotine pouches, IQOS heated tobacco products and U.S. investments. A 2Firsts review of FDA records found that several ZYN products displayed at the booth were not on the agency's marketing authorization list, including certain nicotine strengths and flavors. A PMI booth representative also confirmed that IQOS is currently sold in three U.S. states, while the newer IQOS ILUMA system remains under FDA review.

Wang Gongcheng, deputy administrator of China’s State Tobacco Monopoly Administration, met KT&G Chief Operating Officer Lee Sang-hak in Shanghai on September 1, according to Oriental Tobacco News. The meeting comes as China seeks public comment on a draft mandatory national standard for heated cigarettes. A federal judge in Texas on Oct. 8 granted a joint request by the FDA and plaintiffs including Altria subsidiaries Helix Innovations and NJOY to stay litigation challenging the agency's 2021 PMTA rule. The court cited FDA's anticipated rulemaking concerning the regulation at issue. FDA announced on Sept. 28 that it intends to reassess the PMTA framework and could initiate new rulemaking to replace it. The parties must file a joint status report within 45 days and every 45 days thereafter. A motion by three Reynolds American companies to intervene remains pending.
