Quebec to Ban Flavored Vaping Products
Quebec Health Minister plans to propose regulations for the products and packaging standards of vaping products, including limiting sales to tobacco flavor, with the aim to reduce youth vaping.

Quebec is set to draft regulations that would ban the sale of flavored vaping products, with the exception of tobacco flavor, in a bid to curb youth vaping. The anticipated legislation follows recommendations from a special intervention group on vaping, which includes representatives from various government departments, the Quebec Institute of Public Health (INSPQ), clinicians, and public health directors.

 

Under the proposed amendments to the Tobacco Control Act, in accordance with sections 10 and 11 of the Regulations Act (chapter R-18.1), that the Regulation to amend the Regulation under the Tobacco Control Act, appearing below, may be made by the Government on the expiry of 45 days following this publication. 

 

Lastly, the draft Regulation makes section 29.2 of the Tobacco Control Act (chapter L-6.2), insofar as it relates to the prohibition from selling, offering for sale or distributing a tobacco product that has a flavour or aroma other than that of tobacco, applicable to electronic cigarettes or any other devices of that nature, including their components and accessories.

 

The government cites a significant increase in high school students vaping, with the number of students who reported having vaped in the prior 30 days rising from four per cent in 2013 to 21 per cent in 2019. 

 

The gazette also includes amendments to regulate the packaging and product specificaltions. This legislation is expected to come into force on the 90th days of the gazette.

 

While this move is likely to affect businesses specializing in vaping products, leading to reduced revenue and job losses, businesses offering a variety of other products, such as convenience stores and gas stations, may see a lesser impact.

 

This Regulation comes into force on the ninetieth day following the date of its publication in the Gazette officielle du Québec.
