TGA Sets 2026–2027 Compliance Principles, Flags Vaping Goods as a 2026 Priority

The Therapeutic Goods Administration (TGA) has released its Compliance Principles for 2026 and 2027.Among 12 therapeutic goods categories identified for priority compliance and enforcement activity, TGA includes vaping goods, and it plans a further review of these priorities in March 2026.

According to TGA, the Therapeutic Goods Administration has published the TGA Compliance Principles 2026 and 2027, setting out enforcement directions that include：

 

proactive scrutiny of advertising, particularly across digital environments; 

action against unapproved and falsified products, including those supplied via e-commerce and social media; 

improved access to compliance information through guidance and education; 

action to address false and misleading online information, including social media and influencer content; 

and enhanced compliance tools to address risks linked to AI-generated misinformation and deceptive endorsements, alongside a stated focus on visibility of enforcement action and non-compliance in digital channels.

 

The document also sets out priority focus areas. From January 1, 2026, TGA’s compliance and enforcement activity is set to focus on 12 categories of therapeutic goods, including vaping goods. TGA also notes that the next review of these priority areas is scheduled for March 2026.

 

TGA further states it will continue to undertake other case-based compliance activity and investigations and may take action on non-compliance regardless of whether the matter falls within a stated priority.

Australia’s state of Victoria has activated new powers allowing Tobacco Licensing Victoria and police to shut premises suspected of selling, supplying or possessing illicit tobacco for up to 90 days. Longer closures can be ordered by a magistrates’ court. Businesses subject to closure orders must generally cease all trading and will be placed on a public list. Breaching a closure order can carry penalties of up to A$2.5 million and 20 years in prison.

The U.S. Department of Health and Human Services has named Bret Koplow permanent director of the FDA’s Center for Tobacco Products, ending his period as acting chief. Koplow has spent years working on tobacco regulation, law and policy inside the FDA and, while serving as acting director, pushed for faster PMTA reviews and nicotine pouch review pilots. HHS also said CTP will prioritize innovation and access to less harmful alternatives for adult smokers while continuing efforts to protect youth.

China’s Zhengzhou Tobacco Research Institute develops end-to-end heated tobacco analysis to trace aerosol compound origins
The Zhengzhou Tobacco Research Institute of China National Tobacco Corporation has filed a patent application for an end-to-end method to analyze the migration and transformation of chemical compounds in heated tobacco products. Using GC-Orbitrap/MS non-targeted analysis, the method compares tobacco substrate and aerosol samples to distinguish compounds transferred directly from the substrate from those newly formed during heating, while also calculating transfer rates. In an example involving nine heated tobacco products, the patent identified 17 newly formed thermal decomposition compounds and 38 transferred compounds.

UK-listed consumer goods group Supreme plc says it continues to expect FY27 trading to meet market expectations as the Vaping Products Duty takes effect on October 1, while maintaining a comparatively positive view of the new tax and compliance regime. Supreme has said the framework could increase compliance complexity for smaller operators and contribute to market consolidation, while its manufacturing, compliance and distribution scale may allow it to gain share. Its 88Vape brand will retain its value positioning.
