Canada's Prince Edward Island Amends Law on E-cigarette Fines

According to recent reports from CBC, the revised provisions of the Tobacco and Vaping Sales and Access Act, which came into effect on February 1st in Prince Edward Island, Canada, significantly increase the maximum fine for businesses found in repeated violation, with fines of up to $25,000.

 

Prince Edward Island, Canada has raised the minimum age for the purchase of e-cigarette products to 21 starting in 2020 and will ban the sale of flavored products entirely in 2021.

 

Under the revised law, judges at the provincial level courts are authorized to issue orders prohibiting non-compliant businesses from selling related products for up to 90 days.

 

Officials from the Chief Public Health Officer's office have stated that while most retailers are following regulations, fines have increased in order to deter continued violations.

 

Last Thursday, Vape Head representative Matthew Middleton was charged with two offenses for selling flavored tobacco products and for selling products to minors. However, the company is considered "lucky" because just two weeks before the new fines took effect on January 18th, the store was found for the fourth time to be selling flavored products, and if charged after February 1st, fines could have been as high as $25,000.

 

The company must be ultimately found to pay $2,100 before April 30th.
