Expanding Smoke-Free Areas and Banning E-Cigarettes in Spain
Spain's Ministry of Health is considering expanding smoke-free zones and banning e-cigarettes in a tobacco control plan.

According to a recent report by the European magazine, the Spanish Ministry of Health is considering a proposal to expand smoke-free zones and ban the use of e-cigarettes as part of an anti-tobacco initiative.

 

The Ministry of Health will expand the scope of smoke-free areas as a key initiative, which will include terraces, beaches, as well as vehicles with minors and pregnant women. This measure will encompass all tobacco products, including e-cigarettes.

 

The Minister of Health, Mónica García, and the Secretary of State for Health, Javier Padilla, stated during a press conference:

 

We must reexamine this plan, as it is the only measure that can offer a longer lifespan and improved quality of life for the population, specifically by reducing smoking.

 

Garcia cited the draft of the "Comprehensive Smoking Prevention and Control Plan 2021-2025" formulated by her department in December 2019, which was ultimately finalized with input from the Scientific Association and the National Smoking Prevention Committee (CNPT). The plan aims to expand smoke-free areas, such as vehicles, beaches, or terraces where minors and pregnant women are present, as well as address new challenges posed by e-cigarette products.

 

Reducing the use of smoking and e-cigarettes has emerged as a key focus, confirmed Garcia. During this legislative period, the anti-tobacco initiative will primarily revolve around several laws aiming to decrease tobacco consumption, particularly among minors.

 

The Ministry of Health is set to regulate the use of e-cigarette devices, which former Health Minister José Miñones recognized as not being the smoking cessation method they are promoted to be. According to the National Tobacco Prevention Committee (CNPT), e-cigarettes increase the likelihood of becoming a traditional tobacco smoker fourfold.

 

In addition, 80% of underage smokers begin their habit with e-cigarettes.

 

The Andalusian region has recently announced a ban on the sale of e-cigarettes to minors, with the aim of addressing the issue of underage smoking.

 

If the "Smoking Prevention and Control Program" becomes law, smoke-free areas will expand. Not only will smoking be prohibited on terraces, but also in outdoor sports fields (such as football or athletics tracks) and outdoor areas where minors are expected to be present, including beaches.

The U.S. Court of Appeals for the Ninth Circuit upheld the FDA’s denial of MH Global LLC’s applications to market flavored electronic nicotine delivery systems (ENDS). The court ruled that FDA’s comparative-efficacy framework, which requires applicants to show that flavored products provide greater cessation or switching benefits than tobacco-flavored alternatives, is consistent with the Tobacco Control Act’s “appropriate for the protection of the public health” standard. The court also found that FDA was not required to establish the framework through notice-and-comment rulemaking.

The Global State of Tobacco Harm Reduction, a project operated by Knowledge·Action·Change, estimates that about 200 million people worldwide use non-combustible nicotine products including vapes, heated tobacco, nicotine pouches and snus. Its 2026 report says use of these products rose alongside declining smoking rates in 28 countries it analyzed. The data do not establish that all 200 million users have quit smoking, nor do they prove a direct causal relationship. GSTHR also says regulatory restrictions on the products continue to expand in many markets.

Korea Customs Service has tightened import controls on nicotine-analog and nicotine-free e-cigarette liquids, placing the products under 100% document review and subjecting all e-cigarette liquid import declarations to pre-clearance ingredient analysis. As of September 20, 2026, South Korea had imported about 15 metric tons of nicotine-analog liquids, 99.99% from China, and about 316 metric tons of nicotine-free liquids, including roughly 315 metric tons, or 99.7%, from China. The measures follow South Korea's April expansion of its tobacco definition to include synthetic nicotine products and include new checks on Chinese manufacturing, transaction and export documentation.

German Tobacco Tax Revenue Falls 10.8% Through August as Tax-Paid Cigarette Volume Drops 12.6%
Germany collected €9.789 billion in total tobacco tax revenue from January through August 2026, down 10.8% from a year earlier, according to the Federal Ministry of Finance. Germany's tobacco tax base covers not only cigarettes and fine-cut tobacco but also heated tobacco and vaping liquids taxed as tobacco substitutes. The German Association of the Tobacco Industry and Novel Products, or BVTE, citing federal statistical data, said tax-paid cigarette volume fell 12.6% to 40.6 billion sticks. BVTE is using the latest figures to argue against further tax increases planned from 2027 through 2030, while Germany's parliament is scheduled to hold a first reading of the bill on September 24.

A U.S. Customs and Border Protection proposal to collect foreign export declarations and other overseas customs documents could expose discrepancies in the value, classification and description of China-made vape shipments entering the United States. A veteran Chinese logistics professional told 2Firsts that the measure, if implemented, could undermine the all-inclusive shipping model used by some unauthorized vape exporters and push parts of the trade toward costlier underground channels. The risk extends beyond higher duties: accurately declared products may also be more readily identified as unauthorized e-cigarettes subject to FDA enforcement.
