Regulatory Background: Texas Bans E-Cigarettes Made in “Hostile Countries”

As previously reported by 2Firsts, the State of Texas has enacted a new law — effective September 1 — that prohibits the sale of e-cigarettes containing components manufactured in China or in other nations designated by the U.S. as “foreign adversaries.”

Key Provisions of the New Law Include:

  • Ban on youth-targeted marketing:
Prohibits packaging that includes cartoons, celebrity names, or imagery imitating candy, fruit juice, and other food products.
  • Ban on disguised e-cigarettes:
Prohibits products designed to look like everyday objects such as highlighters, pens, cosmetics, smartwatches, or USB drives.
  • Ban on products from specific origins:
Prohibits the sale of e-cigarettes wholly or partially manufactured in China or other listed “foreign adversary” countries.
  • Ban on illegal additives:
Prohibits e-cigarettes containing cannabinoids, alcohol, kratom, tianeptine, or other restricted substances.

The law also broadens the definition of e-cigarettes to include non-nicotine devices.

It defines an e-cigarette as:

“An electronic cigarette or any other device that delivers nicotine or other substances to a person inhaling from it by means of mechanical heating elements, batteries, or electronic circuits; or (ii) a consumable liquid solution or other material vaporized or aerosolized during the use of such a device, whether or not it contains nicotine.”
