FDA Issues Warning Letters to Five Online Retailers Selling Unauthorized GEEK BAR E-Cigarettes
FDA warns five online retailers for selling unauthorized disposable e-cigarette products under Geek Bar, Lost Mary, and Bang brands.

On July 31st, the Food and Drug Administration (FDA) issued warning letters to five online retailers for selling unauthorized disposable e-cigarette products under the brands Geek Bar, Lost Mary, and Bang.

The retailers who have been warned include:

  • Smoke and Vape Company, LLC (doing business as Smoke and Vape Co.);
  • Smoking Vibes LLC (doing business as Smoking Vibes);
  • Cavalry Industries (doing business as Select Vape);
  • HTXW LLC (doing business as FOMO Culture);
  • Global Supply Allies Inc. (doing business as Vapor Grab).

These warning letters are the result of ongoing monitoring by the FDA of various surveillance systems, including reviewing various data to identify emerging products that may be appealing to or popular among adolescents. For example, the latest data shows that sales of the Chinese e-cigarette brand Geek Bar have recently increased, potentially attracting adolescents.

The FDA stated that retailers who received warning letters have 15 working days to respond, detailing the actions they will take to address the violations outlined in the warning letter and prevent future violations. If the violations are not corrected in a timely manner, the FDA may take further action, such as injunctions, seizures, and/or civil penalties.

As of August 1, 2024, the FDA has authorized 34 types of e-cigarette products and devices. The FDA holds retailers accountable for selling unauthorized tobacco products, especially those popular among youth. To date, the FDA has issued over 680 warning letters to companies manufacturing, selling, and/or distributing unauthorized new tobacco products, over 690 warning letters to retailers selling unauthorized tobacco products, and filed civil penalty complaints against 64 manufacturers and over 140 retailers, accusing them of distributing and/or selling unauthorized tobacco products.
