FDA Seeks Fines for Unauthorized Tobacco Sales from Retailers
FDA seeks fines from 11 retailers for unauthorized tobacco sales, warning letters ignored, total penalty $20,678 each.

On September 23, the US Food and Drug Administration (FDA) announced that it is seeking fines against two physical retail establishments and nine online retailers. The FDA had previously issued warning letters to these retailers for selling unauthorized tobacco products, but follow-up inspections found that they had not corrected their violations. Therefore, the FDA is now seeking civil fines of $20,678 from each retailer.


So far, the FDA has filed civil penalty lawsuits against 70 manufacturers and 160 retailers, accusing them of distributing or selling unauthorized tobacco products.

According to China’s patent office records, a patent owned by China Tobacco Hubei Industrial Corporation (CTHB) for “cigarette paper and a cigarette for microwave heating” was granted on May 19, 2026. The patent describes cigarette paper with an outer wrapping layer, a heating layer, and an isolation heat-conducting layer, allowing it to absorb microwave energy, convert it to heat, and transfer that heat to the aerosol-generating substrate.

FDA Expands ENDS Market Access With First Authorization of Non-Tobacco and Non-Menthol Products
The U.S. Food and Drug Administration (FDA) announced on May 5, 2026 that it authorized the marketing of four Glas electronic nicotine delivery system (ENDS) products through the premarket tobacco product application (PMTA) pathway. The authorized products are Classic Menthol, Fresh Menthol, Gold and Sapphire pods, each containing 50mg/ml, or 5%, tobacco-derived nicotine.
