Under Senate Bill 428, students found in possession or using a vape or e-cigarette on campus may be sent to their district's disciplinary alternative educational program. Benavides has the option to put students caught vaping on a 60-day probation. If they attend classes and stay out of trouble with the law during this time, their charge will be dismissed.

 

Judge Benavides believes that early intervention is key to tackling the issue of vaping among students. By reaching out to kids at a younger age, he hopes to create a more positive outcome in eradicating vaping. He has seen many students enter his courtroom in trouble, but come out with a new perspective on life.

 

Sylvia Zalazar, a graduate of Texas A&M University-Corpus Christi, understands the value of a second chance. She credits her own experience with getting a second chance for inspiring her to change her life for the better.

 

In addition to legal consequences, it is important for students to educate themselves about the harmful effects of vaping. Nurse Practitioner Sylvia McMahan warns that vaping can increase blood pressure and pulse, potentially leading to heart problems, especially when combined with energy drinks.

 

The implementation of this new consequence aims to deter students from vaping and educate them about the risks involved. It is hoped that these measures will contribute to the reduction of vaping among students in Texas schools.
