U.S. Federal Court Orders Vape Website Permanently Shut Down Over Illegal Flavored E-Cigarette Sales

According to AMNY on May 22nd, an e-cigarette company located in Long Island, New York, has been permanently shut down following the signing of a federal court agreement. The agreement requires the company to immediately cease all sales of flavored e-cigarettes nationwide and prohibits them from selling such products in New York City in the future.

 

The e-cigarette retailer operates online under the name pricepointny.com, selling products that have long been banned by city laws and are widely used by teenagers. According to the agreement, the company and its operators Weis Khwaja and Hamza Jalili will be fined $1000 for each violation of the agreement.

 

The agreement resolves a civil enforcement lawsuit filed by New York City Mayor Eric Adams and New York City Corporation Counsel Muriel Goode-Trufant in November 2024, which alleged that Price Point violated the federal Prevent All Cigarette Trafficking (PACT) Act and involved fraud and public health regulations.

 

As early as 2020, the FDA issued a warning letter to Price Point, stating that their sales practices were in violation of federal laws. However, the company continued to sell flavored e-cigarettes online. An investigation revealed that from May 2023 to July 2024, New York City inspectors documented 20 instances of online purchases without age verification and labeling requirements. These products included enticing candy and fruit flavors, clearly targeting young consumers.

 

According to data from the Centers for Disease Control and Prevention (CDC), 80.6% of e-cigarette sales in the United States involve flavors such as fruit and candy. However, city laws only allow the sale of tobacco, mint, menthol, and wintergreen flavors.

 

Currently, we have taken proactive measures and successfully shut down Price Point, safeguarding the nation's health," Adams added. He mentioned that they have previously closed over 1,400 illegal stores and seized over $96 million worth of illicit products.

 

The court agreement bans the defendants from engaging in any transactions involving the entry of flavored e-cigarettes or nicotine delivery systems into New York City, and applies to any future companies or affiliated businesses. As part of the agreement, the city has waived any claims against the company for past actions, but reserves the right to enforce against future illegal activities.

 

Good-Truevant described the settlement as a "public health and legal victory." She emphasized that the city government will closely monitor the implementation of the agreement to ensure compliance.

 

In 2023, New York filed a federal lawsuit against four major illegal e-cigarette distributors, and in 2024, sued 11 wholesale distributors in New York. The cases are currently being heard in federal court.
