
According to a report by LETA on July 2, the manufacturer of the Latvian e-cigarette brand "Salt", Pro Vape, has raised concerns with the Constitutional Court (ST) regarding the proposed ban on e-cigarette flavors next year.
The Constitutional Court has taken up the case and will assess whether the amendments to the "Tobacco Products, Tobacco Alternatives, Smoking Herbal Products, E-Cigarette Devices and their Liquid Refills Act" passed by Parliament earlier this year comply with the first three clauses of Article 105 of the Constitution.
According to the amendment, starting from next year, Latvia will prohibit the sale of flavored e-cigarette liquids and tobacco alternative products.
Pro Vape has raised objections to these provisions in the revised law.
The company requested an evaluation to determine whether these changes are compatible with the first three sentences of Article 105 of the Constitution. Article 105 of the Constitution stipulates that every person in Latvia has the right to property, that property cannot be used for purposes contrary to the public interest, and that property rights may be limited by law.
