USITC Decision: Extension of Deadline for E-Cigarette Investigation
USITC extends deadline for investigation into disposable e-cigarette devices, impacting 25 companies, with final ruling expected by 2025.

On August 29th, the United States International Trade Commission (USITC) announced its decision not to review the preliminary ruling (Order No. 37) issued by the Chief Administrative Law Judge (CALJ) on July 31, 2024. This ruling extends the target completion date of the investigation to September 29, 2025.


The U.S. International Trade Commission (USITC) has decided not to review the Chief Administrative Law Judge's (CALJ) preliminary ruling (Order No. 37) issued on July 31, 2024, pursuant to Section 337 of the 1930 Tariff Act (19 U.S.C. 1337) and the Commission's rules (19 CFR Part 210), extending the target completion date of the current investigation to September 29, 2025. The purpose of this extension is to avoid scheduling conflicts with other investigations, therefore the final determination will not be made until May 29, 2025.


This investigation stemmed from a complaint filed on December 15, 2023 by R.J. Reynolds Tobacco Company and R.J. Reynolds Vapor Company, alleging that certain disposable e-cigarette devices and their components and packaging violated Section 337 of the Smoot-Hawley Tariff Act of 1930 due to false advertising, false country of origin labeling, and unfair competition practices, severely harming the domestic industry in the United States. A total of 25 companies are being investigated, including tobacco and e-cigarette related companies in the United States, Shenzhen, and other regions. On June 13, 2024, the committee approved the addition of four more companies to be investigated.


The committee's final decision will be announced before September 29, 2025, and the investigation results could have a profound impact on the relevant markets and companies.
