Vietnam Government Seeks Public Opinion on Revised Export and Import Tax Regulations
Vietnamese government seeks public opinion on revising and supplementing regulations on export, preferential import tax rates, and quotas.

According to a report by Doanh Nhan Sai Gon, the Vietnamese government is seeking feedback on revising and supplementing certain provisions of Government Decree 26/2023/ND-CP regarding export and preferential import tax rates, commodity lists, and absolute quotas.

 

There is a belief that it is necessary to establish import tax rates for personal electronic devices and similar vaporizing devices, especially for those classified under code 8543.40.00, similar to the approach taken for goods under group 24.04. This is seen as a way to restrict the use of products that may pose health hazards.

 

The Ministry of Finance in Vietnam has stated that the import tax for e-cigarette products should be set at a uniform rate of 50%, the same as traditional tobacco products, in order to prevent their widespread circulation.

 

Additionally, the Vietnamese government has revealed that currently, due to the lack of clear policies on e-cigarette products, these types of products have not officially entered the Vietnamese market. The majority of e-cigarette products on the market are smuggled.

U.S. Ninth Circuit Upholds FDA Denial of MH Global’s Flavored Vape PMTA Applications
The U.S. Court of Appeals for the Ninth Circuit upheld the FDA’s denial of MH Global LLC’s applications to market flavored electronic nicotine delivery systems (ENDS). The court ruled that FDA’s comparative-efficacy framework, which requires applicants to show that flavored products provide greater cessation or switching benefits than tobacco-flavored alternatives, is consistent with the Tobacco Control Act’s “appropriate for the protection of the public health” standard. The court also found that FDA was not required to establish the framework through notice-and-comment rulemaking.

As FDA Reshapes PMTA Reviews and ENDS Enforcement Priorities, CTP Acting Director Bret Koplow to Keynote NATO Event for a Retail Network of 66,000-Plus Stores
Bret Koplow, acting director of the U.S. Food and Drug Administration's Center for Tobacco Products, will deliver a keynote and participate in a fireside chat at the National Association of Tobacco Outlets' Sept. 29-30 conference in Washington. His appearance comes months after the FDA moved to accelerate PMTA reviews and introduced a more differentiated enforcement policy for certain unauthorized ENDS and oral nicotine pouch products. The agency also plans a public list identifying manufacturers and products it does not currently intend to prioritize for enforcement under the May guidance. NATO says its membership includes more than 66,000 retail stores, making product-status transparency and enforcement boundaries directly relevant to the retail sector.

British American Tobacco (BAT) has called for stronger retailer involvement in shaping future nicotine product regulations in the UK, arguing that frontline market feedback should be considered during policy development. BAT said retailers provide direct insight into consumer behavior, market changes and regulatory implementation challenges. The comments come as the UK nicotine market undergoes regulatory changes, including the disposable vape ban, Vaping Products Duty and efforts to address illicit vape sales.
