Vietnam’s Health Ministry Proposes Including E-Cigarettes and Heated Tobacco in the Investment Law Ban List
Vietnam’s Ministry of Health has submitted a proposal to the Government Office recommending that “e-cigarettes and heated tobacco products” be added to the list of prohibited investment and business sectors in the amended Investment Law. The proposal aligns with National Assembly Resolution No. 173/2024/QH15, which bans the production, trade, import, and use of these products starting in 2025.

2Firsts, Nov. 12, 2025 — According to the Ministry of Health of Vietnam, the ministry has submitted an official document to the Government Office proposing that the amended Investment Law include a clause prohibiting investment and business activities involving e-cigarettes and heated tobacco products.

 

The proposed amendment concerns Article 6 of the Investment Law, which defines prohibited investment sectors. The move is intended to align with National Assembly Resolution No. 173/2024/QH15, adopted on Nov. 30, 2024, which states:

 

“The National Assembly agrees to prohibit, from 2025 onward, the production, business, import, storage, transport, and use of e-cigarettes, heated tobacco, and any addictive or health-harming substances.”

 

Following this resolution, the Prime Minister’s Decision No. 1665/QĐ-TTg dated Aug. 5, 2025, instructed the Ministry of Finance to “review and amend certain provisions of the Investment Law” and propose “solutions ensuring legal consistency and compliance among enterprises.”

 

During a National Assembly group session on Nov. 11, MP Lê Hoàng Anh from Gia Lai province proposed explicitly adding “e-cigarettes, heated tobacco, and other new-generation tobacco products” to the list of prohibited investment and business activities.

 

The revised Investment Law remains under discussion and is expected to be submitted for formal approval in the next legislative session.

Eleftheria (Ria) Kioupritzi, a biopharmaceutical professional with more than 15 years of experience, has joined Philip Morris International as Director Scientific Affairs within Corporate Affairs. She previously served at Roche as Senior Scientific Communications Director for Neuroscience and Rare Diseases and worked extensively in spinal muscular atrophy. Her earlier career also covered competitive intelligence, clinical and regulatory monitoring, pipeline development and launch preparation. During her time working in Roche's SMA field, Evrysdi passed through several U.S. FDA milestones, including its initial approval, an expanded indication for younger infants and approval of a tablet formulation. Public records do not show that Kioupritzi herself led the FDA submissions.

French vaping company Kumulus Vape reported first-half 2026 revenue of €25.5 million, down 8.3% year over year, as its core B2B distribution business fell 11% to €21.6 million. B2C and store-network revenue rose 5.6% and 17.8%, respectively. Commercial margin increased to 26.3% from 21.7%, while net profit rose 24.1% to €0.8 million. The company attributed the profitability improvement to catalog optimization, logistics restructuring and the ramp-up of Labster, its in-house production unit for proprietary brands.

The initial Vuse Pro rollout targets about 50,000 stores. The system is taking shape as unauthorized vapor products remain dominant in parts of the U.S. market: a 2026 study estimated they accounted for 69.4% of tracked brick-and-mortar e-cigarette dollar sales in December 2025.

Canadian Health Minister Marjorie Michel says she is not considering loosening retail restrictions on nicotine pouches. Meanwhile, Unsmoke Canada, linked to Philip Morris International's Canadian business, is pushing to allow pouches in convenience stores and other general retail outlets. Health Canada also acknowledges continued unauthorized sales, while recent research shows rising pouch use among Canadian youth aged 16 to 19.
