Court Rules E-cigarette Packaging Warnings not Violate Law in South Korea
Seoul court rules e-cigarette health warnings on packaging lawful; rejects lawsuit against South Korean health institute.

According to a recent report from South Korean media YTN, the Seoul Central District Court ruled on April 21 that e-cigarette packaging with health hazard warning images did not violate the law. The court denied the claims of the plaintiffs in a compensation lawsuit filed by a smokers' rights group against the Korea Health Development Institute.

 

The court stated that although some opinions claim that e-cigarettes pose less harm to health compared to traditional cigarettes, this viewpoint of reduced health risks is not widely accepted. Additionally, the court does not support the government recommending the use of e-cigarettes to the public simply because they may cause less harm.

 

According to a further ruling by the court, the graphic warnings and anti-smoking advertisements regarding the addictive nature and health risks of e-cigarettes are fact-based, and therefore legally sound. In October 2023, a group of smokers' rights activists filed a lawsuit claiming that the warnings on cigarette packages and anti-smoking advertisements violated their rights to smoke, equality, and reputation.
