
The board of supervisors in Martinez-Contra Costa County in California will consider a law that permits the sale and delivery of flavorless cannabis e-cigarette products.
The staff suggested and directed the county health department to develop a plan aimed at increasing awareness about the dangers of youth marijuana e-cigarettes, curbing the illegal market, and with funding from the marijuana industry, recommending the plan for a return to the board.
Despite Californians approving Proposition 64 in 2016 to legalize adult-use recreational marijuana with over 60% of county voters in favor, regulatory agencies passed a law in 2018 to standardize commercial cannabis activity.
This regulation establishes sales and delivery standards and requires anyone involved in commercial marijuana activities or delivery to obtain a county health permit, as well as other permits required by the county and state.
The City of Contra Costa has allowed for the sale of recreational cannabis vaping products, which is not limited to non-incorporated areas.
A new law only applies to flavorless electronic cigarettes. In November 2019, the county committee banned the sale of tobacco electronic cigarette products, flavored tobacco products, and menthol cigarettes. The law also prohibits the sale or delivery of marijuana electronic cigarette products.
Staff members who participated in the meeting reported, "It is evident that many elderly and other adult individuals rely on marijuana-infused electronic cigarette products for entertainment and medicinal purposes. According to current laws, elderly and adult individuals living in non-licensed areas are unable to obtain marijuana-infused electronic cigarette products from any source.
A new regulation will allow the sale and delivery of flavorless marijuana e-cigarette products in unincorporated areas, while continuing to prohibit the sale of tobacco e-cigarette products, flavored tobacco products, menthol cigarettes, and flavored marijuana products in those same areas. The purpose of the regulation is to ensure that elderly and other adults who use marijuana e-cigarette products are not using unregulated and potentially contaminated products, and to address geographic equity concerns in accessing legal products.
