According to a report from Rynekzdrowia on March 4th, the Polish Senate Health Committee passed a legislative amendment without modifications, aimed at implementing EU directives on e-cigarettes and other tobacco products. The law explicitly prohibits the sale of flavored heated tobacco products.
On March 4th, the Senate Health Committee reviewed the amendment to the Law on Protecting Health from the Consequences of Tobacco and Tobacco Products, which prohibits the distribution of flavored heated tobacco products in the country.
The amendment also adds a definition for heated tobacco products. Heated tobacco products are a new type of tobacco product that releases nicotine and other substances through heating, which consumers inhale. Depending on their characteristics, this category may be considered smokeless tobacco products or combustible tobacco products.
In order to ensure that relevant manufacturers are able to comply with the requirements of the new regulations, the bill introduced a 9-month transition period. Marek Kos, Deputy Minister of Health in Poland, explained to senators that this transition period allows producers to complete the necessary procedures for declaring new tobacco products within the specified time frame.
According to the drafters of the bill, data from the European Commission shows that the sales growth rate of heated tobacco products has reached 2009% in recent years, with its market share in the EU tobacco market now at 3.33%. Despite EU member states being required to implement related regulations as of October 23, 2023, Poland is noticeably lagging behind. As of now, 22 EU countries have implemented this directive.
After reviewing the amendment, the Health Committee has decided to recommend the Senate pass the bill without any changes. The Senate plans to discuss the bill in a plenary session on March 12th.
