In addition, Reynolds Tobacco of the United States has initiated a 337 investigation against 42 companies, including Heaven Gifts, based on Section 337 of the Smoot-Hawley Tariff Act of 1930.

The article states that "ELFBAR and LOST MARY have launched over twenty new products and redefined industry innovation with four major trends." The article points out that Heaven Gifts' business spans over 100 global markets, serving over 30 million adult users. Its brand products ELFBAR and LOST MARY hold leading market shares in major regions such as Europe and the Americas.

It is worth noting that the article also emphasizes Heaven Gifts' "Lighthouse" Youth Guardian Program, which actively promotes the "three don'ts" for youth regarding electronic vaping products - "don't see, don't hear, don't buy." This initiative covers all aspects of product development, marketing, promotion, and sales, strictly regulating behaviors to prevent youth from accessing electronic vaping products.

Whether it is the high-profile appearance at the Dubai exhibition or the concentrated release of numerous new products, it is clear that Heaven Gifts is ambitious in the market. However, in Heaven Gifts' main market, constant regulatory "alarms" are being sounded.

 

United States: Senate Judiciary Committee Chairman Calls out ELFBAR and other Unauthorized E-cigarette Products

 

The Senate Judiciary Committee held a hearing on June 12th with the theme of "Combating the Epidemic of Youth e-cigarette Use by Enhancing Enforcement Against Illegal e-cigarettes." During the hearing, the popularity of the ELFBAR brand caught the attention of the Senate. The U.S. FDA and Department of Justice were heavily criticized for failing to effectively curb the proliferation of illegal e-cigarettes.

 

Dick Durbin, chairman of the Senate Judiciary Committee, pointed out that despite manufacturers not obtaining authorization, the FDA and Department of Justice still allow thousands of products to be sold on the market, particularly flavored products clearly targeted at children.

 

Brian King, Director of the FDA Center for Tobacco Products, has highlighted that products like ELFBAR cannot be legally sold in China because the government has banned non-tobacco flavored e-cigarettes. He also stated that the FDA has taken measures including issuing warning letters and civil fines, and collaborating with agencies like the Consumer Protection Bureau to combat illegal products. However, due to a backlog of applications submitted by e-cigarette companies, the approval process has slowed down.

 

The FDA and the Department of Justice have announced the establishment of a new task force to address this issue.

 

European Union: ELFBAR New Product Accused of Evading Regulations

 

In the UK, The Daily Mail reports that ELFBAR's new product, the AF5000 e-cigarette, is facing accusations of circumventing UK nicotine laws due to its e-liquid capacity exceeding the legal maximum. The product is equipped with a 2ml built-in e-liquid tank and a 10ml refill oil tank, claiming to provide up to 5000 puffs.

 

Former chairman of the UK House of Commons Health Committee, Steve Brine, and former Conservative Party MP, Caroline Johnson, have expressed concerns about the possibility of this new product falling into the hands of young people and are calling for it to be removed from the market.

 

The Daily Mail also reported that the EU has issued a warning to member states regarding this "dangerous" equipment, which could lead to a ban across Europe.

 

In response, ELFBAR stated that the AF5000 complies with legal regulations and is currently investigating the alert issued by the European Union.

 

United States: Reynolds Tobacco Launches 337 Investigation against 42 Companies Including Heaven Gifts

 

On June 13, RAI Strategic Holdings, Inc., R.J. Reynolds Tobacco Company, RAI Services Company, and R.J. Reynolds Vapor Company filed an application with the United States International Trade Commission (ITC) under Section 337 of the Smoot-Hawley Tariff Act of 1930. They accused certain disposable vaporizer devices and components thereof that are exported to the U.S., imported into the U.S., or sold in the U.S. of infringing on their patents. They requested the initiation of a Section 337 investigation and the issuance of a general exclusion order, limited exclusion order, and cease and desist order.

 

A total of 42 companies, including Heaven Gifts, have been listed as proposed defendants in the lawsuit.

 

Lawyer's Perspective: Striking a Balance Between Compliance and Innovation

 

Tang Shunliang, a partner at Tianyuan Law Firm who has been following the e-cigarette industry for a long time, told 2FIRSTS that innovation must also adhere to regulations.

 

He pointed out that in the e-cigarette market, consumers' behavior often deviates from rational choices. Although compliant products can provide health and safety guarantees, consumers seem to be more inclined to chase market trends.

 

This phenomenon is evident in both domestic and international markets, where compliant products often struggle to attract consumer attention, while products with unique appearances or flavors are more likely to arouse consumer purchasing desires.

 

In addition, many innovations in the market may appear simple and lack technical depth, yet they are able to quickly become popular. For example, the screen design of certain e-cigarettes may not have significant technological advancements, but once it becomes a trend, it can quickly attract the attention and admiration of a large number of consumers.

 

However, the innovation in the e-cigarette industry should not just scratch the surface. Its core should be to ensure providing a pleasurable sensory experience while also minimizing harm to consumer health as much as possible. This means that manufacturers need to find a balance between innovation and compliance when designing and developing new products, meeting consumers' desire for novelty while not sacrificing product safety and legality.

 

Tang Shunliang believes that the healthy development of the e-cigarette industry requires the joint efforts of manufacturers, regulatory agencies, and consumers. Manufacturers should strive to develop products that are both safe and attractive, regulatory agencies need to strengthen enforcement to ensure market regulations, and consumers should increase their awareness of the importance of health and safety, making more rational consumption choices.
