FDA Updates Import Alert Including Red List of E-Cigarettes
The FDA has updated import alerts, including a "red list" for e-cigarette products, giving Customs authority for seizure.

According to a statement from the US Food and Drug Administration (FDA), the FDA has updated its import alert, which includes a "red list" of products that will authorize US Customs and Border Protection to detain potential aerosol products without the need for physical inspection.

 

A new alert allows for the addition of 13 new e-cigarette manufacturers and distributors (10 of which are from China). If the new tobacco products do not comply with the requirements of the Federal Food, Drug, and Cosmetic Act to obtain the necessary marketing authorization, U.S. Customs and Border Protection will have the authority to seize their goods.

 

The 13 new companies and their associated products added in 2024 are as follows:

Acting CTP Director Says FDA Cut Premarket Tobacco Application Backlog by About 70% Over the Past Year
FDA Center for Tobacco Products Acting Director Bret Koplow said at the American Tobacco and Nicotine Forum that the agency has reduced its premarket tobacco application backlog by about 70% over the past year and eliminated the acceptance queue. The UK government announced on April 29 that the Tobacco and Vapes Bill had received Royal Assent and become law. Under the new law, it is illegal to sell tobacco to anyone born on or after Jan. 1, 2009. Indonesia’s Ministry of Health is preparing to implement regulations on electronic cigarettes, as provided for in Government Regulation No. 28 of 2024. Bangkok Port Customs on April 28 announced the seizure of 52,000 complete e-cigarettes, 100 gallons of e-liquid and 126,226 canisters of nitrous oxide, with total economic damage exceeding THB 27 million, or about USD 831,178 based on an April 28 USD/THB rate of 32.484. The e-cigarette and e-liquid shipment was valued at THB 5.56 million, or about USD 171,161, while the nitrous oxide shipment was valued at THB 21.27 million, or about USD 654,784.
