FDA Updates Import Alert Including Red List of E-Cigarettes

The FDA has updated import alerts, including a "red list" for e-cigarette products, giving Customs authority for seizure.

According to a statement from the US Food and Drug Administration (FDA), the FDA has updated its import alert, which includes a "red list" of products that will authorize US Customs and Border Protection to detain potential aerosol products without the need for physical inspection.

A new alert allows for the addition of 13 new e-cigarette manufacturers and distributors (10 of which are from China). If the new tobacco products do not comply with the requirements of the Federal Food, Drug, and Cosmetic Act to obtain the necessary marketing authorization, U.S. Customs and Border Protection will have the authority to seize their goods.

The 13 new companies and their associated products added in 2024 are as follows:

Imperial Brands reported FY25 NGP net revenue of £368 million, up 13.7% at constant currency. Growth in the Americas accelerated sharply, with NGP revenue up 69.8%, driven by the expansion of the modern oral brand Zone. Kentucky to Require Tobacco and Vape Retailers to Be Licensed Starting January 2026

The Kentucky Public Protection Cabinet has reminded all businesses selling tobacco, nicotine, and vapor products that they must be licensed by the Kentucky Department of Alcoholic Beverage Control (ABC) by January 1, 2026. The requirement stems from Senate Bill 100, signed into law by Governor Andy Beshear on March 24, 2025, aimed at strengthening youth protection and enforcing compliance against unlicensed sales.

TASS reported that police dismantled a distribution network in the Moscow region selling nicotine-containing products, e-cigarettes and vapes without mandatory markings, with organizers earning more than 10 million rubles per month (more than about $130,000).
