Poland to ban sale of e-cigarettes to minors in 2025
Polish Health Minister plans to ban e-cigarette sales to under 18s starting January 1, 2025, to combat addiction risks.

According to Portal Samorzadowy, on July 25th, the Polish Health Minister Izabela Leszczyna stated on Polsat News that she hopes to ban the sale of all e-cigarette products to individuals under the age of 18 starting from January 1, 2025.


E-cigarettes containing nicotine have of course been banned, but in reality, these e-cigarettes are no different, as they all pretend to be watermelon or strawberry flavored.


This is why we say: there are no sales, no advertisements on the Internet or any vending machine. We do not sell products to people under 18... this way our children, our teenagers will not fall into this terrible addiction.


The draft amendment of the Tobacco and Tobacco Product Health Protection Act is currently seeking feedback. The drafters emphasize that the revision of the Tobacco Act, enacted on November 9, 1995, is necessary due to the urgent need to reduce the phenomenon of young people using e-cigarettes.


At present, e-cigarettes filled with nicotine-free e-liquid and spare containers do not meet the definition of e-cigarettes or spare containers under the Tobacco Act. The proposed revisions are aimed at including so-called nicotine-free e-liquids in the legal provisions.


This will result in a ban on selling these products to those under 18, restrictions on where these products can be used, a ban on selling them through vending machines and remote sales (including online), as well as a ban on advertising and promotions. Additionally, the revised proposal also requires the director of the Chemicals Management Bureau to report information on these products, mandate that their ingredients comply with legal regulations (such as prohibiting the use of substances with CMR properties), and require appropriate labeling on their packaging.


The project notes that the threat posed by "nicotine-free e-liquid" is not any smaller than products containing nicotine. The popularity of nicotine-free products increases the risk of young people being exposed to tobacco products, similar to nicotine-containing e-cigarettes.


The bill will come into effect three months after it is announced.
