Currently, the legal framework for the e-cigarette market is determined by the Tobacco Act, which was implemented based on Directive 2014/40/EU adopted by the European Parliament and Council on April 3, 2014. This directive aims to harmonize the legal provisions of member states regarding the production, display, and sale of tobacco products and related products, and repeals Directive 2001/37/EC. The provisions of the directive mentioned above apply to the market of e-cigarette liquids containing nicotine.
The proposed regulations aim to bring so-called "nicotine-free liquid" within the legal framework, with specific provisions outlined as follows:
The sale of nicotine-free e-liquid to individuals under the age of 18 is prohibited; restrictions on the use of nicotine-free e-liquid in public places, similar to e-cigarette liquid containing nicotine; the sale of nicotine-free e-liquid through vending machines and remote sales (including online sales) is prohibited; advertising and promotion are prohibited; reporting to the Chemicals Agency is required. These regulations are expected to be implemented in the third quarter of this year.
