
A Kentucky lawmaker plans to introduce a bill to curb illegal vaping products sales to minors, WLKY reported on November 19.
Republican Senator Jimmy Higdon announced that the proposed legislation would mandate all retailers selling tobacco or vaping products to obtain a license.
Under the proposed law, businesses caught repeatedly selling products to individuals under 21 could have their licenses revoked.
The bill also grants enforcement authority to the Alcohol Beverage Control (ABC) agency and allows police to inspect these businesses without requiring a search warrant.
"Regulatory authority would be similar to alcohol regulations," Higdon said. "It would give the officers the ability to enter and inspect the premises without a warrant. It will also give them the ability to confiscate evidence of criminal activity."
Suppliers must pay any outstanding fines to renew their license, and if the license is revoked, they cannot reapply for a new license within two years.
Higdon also said that first offense fines would be paid by the store clerk who sold the goods to minors, with subsequent fines to be covered by the retailer.
During the 2024 legislative session, lawmakers in Kentucky passed House Bill 11, aimed at curbing underage vape use by restricting the sale of "authorized products" or products certified by FDA as "a safe harbor certification".
