NACS Supports Proposed FDA Rule on ENDS Imports Tracking

The National Association of Convenience Stores (NACS) commends the FDA's proposed rule requiring tracking numbers for ENDS imports.

According to Convenience on October 18, the National Association of Convenience Stores (NACS) has submitted a letter to the U.S. Food and Drug Administration (FDA) regarding proposed rules to require submission of tracking numbers (STNs) for the importation of electronic nicotine delivery systems (ENDS). The letter states that requiring STNs is an important and necessary step to ensure that illegal products do not enter the U.S. market, and NACS appreciates the FDA taking this important measure.

Due to the problem of a large amount of illegal products entering the United States, NACS suggests that proposed regulations should be expanded to cover more products and additional measures should be taken to curb the influx of these illegal products.

In the letter, the following information is included:

The proposed rule would require importers of ENDS products to provide STNs, which would allow Customs and Border Protection to work with the FDA to ensure that manufacturers of these products have timely submitted Pre-Market Tobacco Product Applications (PMTAs) as required.

However, the proposed regulations do not address the risk of other identified products (such as nicotine pouches) entering the market that may not comply with FDA regulations. The FDA should take preventive measures to guard against such risks. History has shown that many manufacturers are willing to exploit loopholes in the existing regulatory and enforcement system, which can be highly profitable for these companies. The FDA should take action before these risks become widespread, as handling them after an illegal market has formed will be more complicated and costly.
